Terms of Service

The agreement between you and IQnero for using our smart pool-leak-monitoring service, app, and device.

Last updated: 17 October 2026

This page is a plain-language template provided for review. It is not legal advice and should be read and approved by qualified legal counsel before IQnero launches publicly or relies on it in any binding way.

These Terms of Service (the "Terms") govern your access to and use of the IQnero website, mobile app, smart monitoring device, and related services (together, the "Service"), provided by IQnero ("IQnero," "we," "us," or "our"). Please read them carefully. If you are using the Service on behalf of a household, business, or other organization, you are agreeing to these Terms on its behalf.

1. Acceptance of these Terms

By creating an account, joining the waitlist, installing the device, or otherwise using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Service. Some features may be subject to additional terms presented to you at the time you use them; where those additional terms conflict with these Terms, the additional terms apply to that feature.

2. What IQnero is

IQnero is a smart pool-leak-monitoring service. A smart meter measures your pool's water flow around the clock, learns your pool's normal usage pattern, and alerts you — in gallons — when usage drifts from normal in a way that may indicate a leak. When a repair is needed, the app lets you schedule a background-checked field technician. The Service combines:

3. Private beta and an evolving Service

IQnero is currently offered in a private beta and is initially available only in the State of Texas, USA. During the beta, the Service is still under active development. Features, coverage areas, availability, and performance may change, be added, be limited, or be removed at any time, and parts of the Service may be incomplete or occasionally unavailable. We may contact you for feedback, and we may use that feedback to improve the Service without obligation to you. Because the Service is evolving, we may update these Terms over time as described in Section 16.

4. Eligibility

To use the Service you must be at least 18 years old and able to form a binding contract. You must have the legal right to install a metering device at the property where the pool is located — for example, you own the property or have the owner's permission. You agree to provide accurate information and to use the Service only for a pool you are authorized to monitor.

5. Your account and security

You are responsible for the information you provide and for all activity that happens under your account. Keep your login credentials confidential, use a strong password, and notify us promptly at info@iqnero.com if you believe your account has been accessed without your permission. We are not responsible for losses arising from your failure to safeguard your credentials. You may close your account at any time as described in Section 15.

6. Subscriptions, plans, and the installation fee

The Service is offered through three subscription plans — Basic, Standard, and Premium — plus a one-time installation fee for setting up the device, which applies to every plan. Basic includes continuous metering and leak alerts; Standard also includes leak detection visits, which are triggered when the device detects a leak; and Premium also includes covered repairs. Pricing shown on our website or in marketing materials — including any monthly figures — is indicative only during the private beta and may change. The plan, price, billing cycle, and installation fee that actually apply to you are the ones confirmed to you at signup before you complete payment.

Unless stated otherwise at signup:

Cancelling during the Commitment Term. If you cancel before the Commitment Term ends, we will issue a single settlement invoice covering (a) the leak detection visits and repairs included in your plan that you have already used, charged at their standard price, and (b) a device-removal fee. Once the settlement invoice is paid, an IQnero technician will remove the device from your property as described in Section 7.

Cancelling after the Commitment Term. Once the Commitment Term is complete, cancelling your subscription is free of charge and the device remains with you, as described in Section 7.

Changing plans. Any change of plan, whether an upgrade or a downgrade, starts a new 36-month Commitment Term from the date the new plan starts. You may upgrade to a higher plan at any time. Moving to a lower plan is possible only by cancelling your current subscription under the terms of this Section and then starting a new subscription, with a new Commitment Term, on the lower plan.

Except where required by law or expressly stated at signup, fees already paid are non-refundable, and cancelling does not entitle you to a refund of the installation fee or of amounts for the current billing period.

7. The IQnero smart device

Your plan includes a smart metering device. The device remains the property of IQnero throughout the Commitment Term described in Section 6 and is provided to you for use as part of your subscription. When the 36-month Commitment Term is complete, ownership of the device passes to you, and it stays with you if you later cancel. If you cancel during the Commitment Term, an IQnero technician will remove the device after the settlement invoice described in Section 6 has been paid. While the device remains our property:

The device depends on power, plumbing, and a working internet or cellular connection at your property. Interruptions to any of these can affect monitoring, and we are not responsible for gaps caused by factors outside our reasonable control.

8. Technician services

Field technicians who perform installations and repairs are independent professionals, not employees of IQnero. We facilitate scheduling, run background checks through our screening provider, and provide reporting tools, but the technician is responsible for performing their work with reasonable skill and care. When you book through the app, you authorize the assigned technician to access the relevant part of your property to carry out the agreed work at the scheduled time. Scheduling is subject to technician availability in your area; we aim to offer timely appointments but do not guarantee a specific technician or time slot. Any dispute about workmanship should be raised with us so we can help address it.

9. Acceptable use

You agree not to:

10. Intellectual property

The Service, including the app, website, device firmware, software, designs, text, and the IQnero name and logos, is owned by IQnero or its licensors and is protected by intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for monitoring your own pool, subject to these Terms. You retain ownership of content you submit (such as notes or photos), and you grant us a license to use that content as needed to operate, maintain, and improve the Service. You may not copy, modify, distribute, or create derivative works from the Service except as expressly permitted.

11. Third-party services

To deliver the Service we rely on trusted providers, including Stripe for payment processing, Checkr for technician background checks, a device and metering partner for water-usage data, Google Fonts for website typography, and a privacy-friendly analytics provider (enabled only where permitted). Your use of features powered by these providers may be subject to their own terms, and we are not responsible for their services. We share only the information needed for each provider to perform its function, as described in our Privacy Policy.

12. Service provided "as is"; no guarantee of leak detection

The Service is provided on an "as is" and "as available" basis. While IQnero is designed to detect unusual water loss and alert you quickly, no monitoring system is perfect. We do not warrant or guarantee that every leak, or every form of water loss or damage, will be detected, measured, prevented, or reported, or that alerts will always be timely or accurate. IQnero is a monitoring aid and is not a substitute for routine pool maintenance, professional inspection, insurance, or your own judgment. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

13. Limitation of liability

To the fullest extent permitted by law, IQnero and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or property damage such as water loss, arising out of or related to your use of (or inability to use) the Service, even if we have been advised of the possibility of such damages. To the fullest extent permitted by law, our total liability for all claims relating to the Service will not exceed the greater of the amount you paid us for the Service in the twelve months before the event giving rise to the claim, or one hundred US dollars. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

14. Indemnification

You agree to defend, indemnify, and hold harmless IQnero and its affiliates from any claims, damages, liabilities, and reasonable expenses (including legal fees) arising out of your misuse of the Service, your violation of these Terms, your violation of any law, or your infringement of the rights of any third party — including claims that you lacked authority to install the device or authorize work at a property.

15. Suspension and termination

You may stop using the Service and close your account at any time; if your subscription is still within its Commitment Term, the early-cancellation terms in Section 6 apply. We may suspend or terminate your access, with or without notice, if you breach these Terms, if required by law, if the device is tampered with, or if we reasonably believe your use poses a risk to the Service, other users, or technicians. We may also discontinue the Service, in whole or in part, including at the end of the private beta. On termination, your right to use the Service ends, any device that remains our property must be made available for removal by an IQnero technician as described in Section 7, and the sections of these Terms that by their nature should survive (such as intellectual property, disclaimers, limitation of liability, and indemnification) will continue to apply.

16. Changes to these Terms

Because the Service is evolving, we may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, notify you through the app, by email, or on our website. Changes take effect when posted unless we state otherwise. Your continued use of the Service after changes take effect means you accept the updated Terms; if you do not agree, you should stop using the Service and may cancel as described above.

17. Governing law

These Terms are governed by the laws of the State of Texas, USA, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in Texas will have jurisdiction over any dispute that is not otherwise resolved, except where applicable law gives you the right to bring a claim elsewhere. Nothing in these Terms limits any rights you may have that cannot be waived under applicable law.
